Annexation. For an annexation ordinance excluding a voluntary annexation (an annexation petitioned for by more than 50% of landowners) or a supervoluntary annexation (an annexation petitioned for by 100% of landowners) adopted after June 30, 2018, the following applies: (1) If the total gross assessed value of property within the annexation territory that is annexed by all annexation ordinances adopted during the calendar year by the municipality is more than 15% of the total gross assessed value of the annexing municipality, all annexation ordinances adopted by the municipality during the calendar year are void unless the county executive approves the Annexation. For an annexation ordinance excluding a voluntary annexation (an annexation petitioned for by more than 50% of landowners) or a supervoluntary annexation (an annexation petitioned for by 100% of landowners) adopted after June 30, 2018, the following applies: (1) If the total gross assessed value of property within the annexation territory that is annexed by all annexation ordinances adopted during the calendar year by the municipality is more than 15% of the total gross assessed value of the annexing municipality, all annexation ordinances adopted by the municipality during the calendar year are void unless the county executive approves the annexation. (2) If the total gross assessed value of property within the annexation territory that is annexed by an ordinances or ordinances adopted on the same date is more than 5% of the total gross assessed value of the annexing municipality, the annexation may be reviewed and approved or denied by the county executive if a member of the county executive requests review of the annexation. Provides that the annexation proceedings are terminated if the county executive votes to deny the annexation. Provides that the annexation is considered approved by the county executive if the county executive does not vote to approve or deny the annexation within 90 days after the annexation ordinance and fiscal plan are filed with the county executive. Requires that a fiscal plan after June 30, 2018, must address any estimated effects the annexation may have on taxing units (in addition to political subdivisions) not included in the annexation. Requires after June 30, 2018, that notice be given of certain annexation proceedings to taxing units and political subdivisions evaluated for purposes of the fiscal plan. ... View more
